This RETROMATH End-User License Agreement ("EULA") is a legal agreement between you (either an individual or organization) and LEARNONLINE for the RETROMATH SOFTWARE identified above which may include INSTALLATION ON A MICRO SD CARD ALONG WITH APPLICABLE DOCUMENTATION ("SOFTWARE").

THE SOFTWARE IS EXCLUSIVELY DISTRIBUTED BY LEARNONLINE, INC.

(“LEARNONLINE”) OPERATING UNDER THE WEBSITE URL WWW.RETROMATH.COM. 

 

LEARNONLINE MAY ENLIST OTHER AUTHORIZED RE-SELLERS FOR EXPANDED DISTRIBUTION OF THE SOFTWARE.

THE SOFTWARE IS NOT WARRANTED FOR FITNESS FOR ANY PURPOSE.  USERS OF THE SOFTWARE ASSUME ALL RESPONSIBILITY FOR ITS SAFE AND EFFECTIVE USE.

IMPORTANT - READ THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT CAREFULLY BEFORE PURCHASE OR CONTINUING WITH AN INSTALLATION OR OPERATION:

By purchasing, installing, downloading or otherwise using the SOFTWARE, you agree to be bound by the terms of this EULA. This license agreement represents the entire agreement concerning the SOFTWARE between you and LearnOnLine, Inc.  (referred to as "licenser"), and it supersedes any prior proposal, representation, or understanding. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE.  

The SOFTWARE is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

License Terms

1. GRANT OF LICENSE.
The SOFTWARE is licensed as follows:

(a) Installation and Use.
LearnOnLine grants you the right to install one (1) copy of the SOFTWARE on one (1) Tiny Arcade hardware platform manufactured by Tiny Circuits of Akron, Ohio a.k.a. AcroSense, LLC.

(b) Single User License.

The RETROMATH Single User License allows a single copy of the SOFTWARE to be installed on and used with only one Tiny Arcade.  When multiple Tiny Arcades are necessary, such as for a school classroom setting, each Tiny Arcade hardware platform must each have a separate RETROMATH Single User License SOFTWARE license. Even though you can load the RetroMath software from the same micro SD card onto each Tiny Arcade that you have, you still must have purchased a separate RETROMATH Single User License for each Tiny Arcade that uses the SOFTWARE.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.


(a) Maintenance of Copyright Notices.
You MUST NOT remove or alter any copyright notices on any and all copies of the SOFTWARE.

(b) Software Distribution.
You MUST NOT distribute registered copies of the SOFTWARE to third parties.

(c) Rental.
You may not rent, lease, or lend the SOFTWARE.

(d) Support Services.
LearnOnLine may provide you with support services related to the SOFTWARE ("Support Services"). Any supplemental software code provided to you as part of the Support Services shall be considered part of the SOFTWARE and subject to the terms and conditions of this EULA.

(e)  Learning Math.

In no event shall LearnOnLine, Eike Decker (software developer), TinyCircuits or any authorized RETROMATH software distributor or reseller be responsible for any improvement or degradation of a student's ability to learn or comprehend the math problems presented in the SOFTWARE.  The instructor is responsible for training students in these concepts, while the role of RETROMATH is primarily for reinforcement of these concepts through drill and practice.

(e) Compliance with Applicable Laws.
You must comply with all applicable laws regarding use of the SOFTWARE.

3. TERMINATION


Without prejudice to any other rights, LearnOnLine may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE in your possession.

4. COPYRIGHT


All title, including but not limited to copyrights, in and to the SOFTWARE and any copies thereof are the property of LearnOnLine. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights not expressly granted are reserved by LearnOnLine.

5. NO WARRANTIES


LearnOnLine expressly disclaims any warranty for the SOFTWARE. The SOFTWARE is provided 'As Is' without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, no infringement, or fitness of a particular purpose. LearnOnLine does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics or other items contained within the SOFTWARE.

 

LearnOnLine makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb, or other such computer program. LearnOnLine further expressly disclaims any warranty or representation to Authorized Users or to any third party.

6. LIMITATION OF LIABILITY


In no event shall LearnOnLine, Eike Decker (software developer) or any authorized RETROMATH software reseller, be liable for any damages rising out of 'Authorized Users' use of or inability to use the SOFTWARE, even if LearnOnLine, Eike Decker, TinyCircuits or software reseller(s) have been advised of the possibility of such damages. In no event will LearnOnLine, Eike Decker or software reseller(s) be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. LearnOnLine, Eike Decker or software reseller(s) shall have no liability with respect to the content of the SOFTWARE or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information.

Can RetroMath Really Teach Math?

RetroMath is a 21st Century math teaching aid made to look and act like a video game.  It's designed to help your students with arithmetic "drill and practice" like the old flash cards.  But first, you will need to teach your students basic arithmetic then use RetroMath to reinforce your teaching methods and your student's learning. Each student learns at their own pace, and you (and they) can see their scores at anytime...it's all included on the Tiny Arcade's screen.

Are There More Games?

Our Fork Lifter game is the first in a series of math-related games; however, this is the only one that's currently available.  You can, however, use the many "entertainment" games on the micro SD card for your students for fun play or as a reward for doing well.
